If your Solicitor is successful in winning the claim process, you are entitled to receive 100% of the awarded compensation, then, out of that compensation amount received you can pay your Solicitor fees and cost as agreed upon which is usually . This can differ from company to company so please make sure you check the fee structure. It's in the best interest of the Solicitor to fight for the highest amount possible. Where the claim is pursued via litigation (i.e Court Proceedings) the fee cap does not apply. In which case the law firm can charge up to 50% of the amount awarded (under a Damages Based Agreement) or an hourly rate as set out in their Conditional Fee Agreement.
